What is home office?

Home office, or “home office” in Portuguese, is a work model in which professionals can carry out their activities from their homes. In other words, it allows work to be done away from the office, without the need to travel.

In Brazil, home office emerged in 1999, but it was only years later that our CLT (Consolidation of Labor Laws) included it as a type of work.

What is the difference between home office and teleworking?

But aren't home office and teleworking the same thing? This is a very common confusion, but the truth is that they are different.

The main difference between working from home and working from home is in legal terms. In other words, working from home is not covered by our legislation. And this makes all the difference in terms of the rights of professionals.

Teleworking also refers to work carried out outside the company. However, since the Labor Reform came into effect, this modality has been included in our CLT.

As for home office, there is no law that defines similar rules. In practice, this means that the rules are the same as those for in-person work, but without it being considered a specific model that needs to be stated in the employment contract.

The latest change we had was during the pandemic, through a Provisional Measure. Some changes were made to our legislation temporarily regarding teleworking rules, so that companies could have greater control over remote work.

What does this change for employees?

The consequences of this difference for employees are quite clear. All those who work from home will not be covered by a law in our CLT.

As a result, these professionals will be subject to the normal laws of a formal employment contract. Let's use an example to make this clearer.

In a specific article of the teleworking law, it is defined that companies must provide whatever is necessary for their employees to be able to work from home, from technological equipment to adequate infrastructure.

All of these materials are the sole responsibility of the company when working remotely, which is not the case when working from home. However, everything can be agreed upon in advance between the parties if the possibility of working from home is defined early on.

What are the advantages of home office?

Home office has become very popular among many professionals, who have seen the advantages of this work model in their daily lives. The main advantages include, by far, greater flexibility, time savings and, above all, a better quality of life.

What are the disadvantages of working from home?

Like other work models, working from home also has its disadvantages. Among them, difficulty concentrating, a feeling of isolation and a lack of routine are some of the most common.

Even for those who live alone , concentrating while working from home can be quite difficult. Especially if you don't have an office or space dedicated exclusively to work.

After all, we are in the comfort of our homes, with our bed, sofa, kitchen, and everything we like at our side. For those who have children, this difficulty is even greater with the little ones at home, wanting to play and receive attention.

If they are not managed well, they can have an even greater impact on your work routine. You may have difficulty waking up earlier, balancing your responsibilities with your children, or even being stuck in the office without managing your working hours properly.

Still, the feeling of loneliness was also a huge problem reported by many, especially during this pandemic period that we are living in.

In a study conducted by the Ipsos Institute, around half of Brazilians stated that they were often affected by feelings of loneliness. We are naturally sociable beings, and the inability to have contact with other people during the last year has seriously affected many people.

What are the home office trends?

Despite this difference, the outlook for the future of home office in the country is very positive. In a study carried out by FGV , the expectation is that, after the pandemic, we will see an increase of around 30% in the number of professionals working from home.

Is home office for me?
