It is now possible to change your name and gender on documents without the need for legal action. Anyone aged 18 or over can request that their birth or marriage certificate be changed at the registry office of origin. But the question is: how do you change your social name ?

CNJ provision 73/2018 limits the change to the first name and surname only, such as: Júnior, Filho, Neto or nephew. Family names cannot be changed, nor can the new name chosen correspond to the first name of another family member.

How to change your social name?

Initially, if the request is made in a registry office other than the one where it was registered, it will be sent between registries for endorsement by the Civil Registry Information Center (CRC).

In view of this, among the required documents according to CNJ Provision 73/2018 are:

• Birth certificate;
• Copy of the General Registry (RG);
• Individual Taxpayer Registry (CPF);
• Copy of voter registration card; and
• Proof of residence.

In addition, medical or psychological reports proving transsexuality may be added, but are not mandatory. And the amounts charged for the service at the registry office may vary according to each state.

In Brasília, for example, in 2022, all these fees for rectification total R$121.50 and, to obtain the new certificate with the changed name, it takes an average of five business days, if the documentation is correct.

However, at the Public Defender's Office in the state where the person interested in the rectification resides, it is possible to obtain information and exemptions from some fees, such as the value of the protest certificate, ensuring that any pending legal issues will be transferred to the new name.

It is worth noting that legal action continues to be required for people under 18 years of age, who need their parents or legal representatives to file a lawsuit requesting a change of name and gender on their birth certificate.

How to obtain the certificates

The issuance of Civil and Criminal Certificates on how to change your social name can be carried out through the websites of each Court of Justice (state) and Federal Regional Court that show the state in which you have resided in the last five years.

On these websites, you can issue digital documents and then print them to add to the application at the registry office. Issuance is free.

Then, the Electoral Court certificate can also be obtained free of charge on the Superior Electoral Court (TSE) website .

Now the Labor Action Certificate can be requested on the digital platform of the Regional Labor Court (the website will depend on the region), where the person lived in the last five years.

Furthermore, for those who serve or have served as military personnel, including Military Police and Firefighters, the Military Justice certificate can be obtained on the website of the Superior Military Court (STM) .
